These terms and conditions (the "Agreement” or “Contract") describe what you are legally entitled to expect from us when you purchase travel related services through us, in addition to your obligations as a customer.
Darina Holidays LLC will not deal and provide any services or products to any of OFAC sanctions countries in compliance with the law of UAE. United Arab Emirates is Darina Holidays LLC country of domicile. Darina Holidays LLC accepts payments online using Visa and Master Card credit /debit card in the AED or USD currencies. If “Credit Card Online” method is selected as the payment then the details on the Customers ID (Card Holder ID) should exactly match that of the credit card used to make the purchase.

The term "you" and "your" refers to the customer visiting our website, booking a reservation through us or otherwise using our services.
Moreover, for the purposes of these terms and conditions the following words or phrases have the meaning shown below, unless the context clearly indicates otherwise:
“Booking” : any order for products or services you make on our Website which is confirmed or accepted by us. Acceptance of the booking will be processed by us immediately, and the confirmation email will be sent accordingly if the booking applies within the credit facility terms and conditions. If the amount of the credit facility is exceeded the booking will be confirmed once the amount of the outstanding will be paid and maintained within the credit amount established.
“Booking Agent” or “Travel Agent” : The online travel agency that manages and operates the website darinaholidays.ae, who in the course of its business provides advice and information and acts as an intermediary in the process of realizing agreements in the field of travel. We as Travel Agent and our Website act as an interface in the transactions.
“Customer” or “Client” : The Company who makes a Booking.
“Service(s)” : a service offered by our website.
“Website” : means the http://www.darinaholidays.ae.

Agreement between You and Darina Holidays LLC
The Web Site is owned and operated by Darina Holidays LLC, (referred to in these terms and conditions as ‘Travel Agent’ whose principal office is at office 2502, One by Omniyat Building, Business Bay, P.O Box 36833, Dubai, United Arab Emirates. Darina Holidays LLC a Dubai DMC established by Trade License N 621110 in 2009 of the Government of Dubai.
The services we offer are governed by the laws of Dubai, and the federal laws of the United Arab Emirates applicable in Dubai. No warranties and/or representations of any kind, express or implied, are given as to the compliance of the information shown on the Web Site or the services we offer with any laws of any other country, and the laws of other countries will not apply to the Web Site or to the services we offer.
We reserve the right to deny access to the Web Site at any time. The notification email will be sent to You with the particular reason prior to the access deny.
“This web site is for use by travel agents only to make travel bookings. We do not accept bookings made by members of the public. Any bookings made in contravention of this rule will be cancelled and a refund will be given, although we reserve the right to deduct an administration fee from any such refund”.
- You agree to be bound by the terms of this Agreement that are applicable to your booking, travel arrangements or use of any website content. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due.
- You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any money paid for your reservation or purchase, (c) you being denied access to the applicable travel related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation. The notification email will be sent to You in case of any violation, and the debit note will be generated with the supportive documents accordingly.
- You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act for or on behalf of any persons included in a booking and accept these terms and conditions on their behalf, and (c) the information supplied by you is true and correct.
- You are responsible for informing such other persons of all terms and conditions applicable to their travel arrangements. You understand that you are financially responsible for any use of our services or website by you and those using your name or account.
- You are responsible for your activities on the Website (financially or otherwise), including the possible use of your user name and password.
Prices are confirmed at the final step of the booking path at the point when you click "Buy now", "Make the reservation" or similar, depending on product purchased.
After you complete your booking, you will receive a confirmation email with a booking number. This is the moment that your contract in relation to the products and services ordered will come into existence. This confirmation email will provide all the details of your booking. Next, we will check that your booking has been correctly entered in booking system and that your payment can be correctly processed.
For flight booking, our obligation to issue the ticket will be subject to your payment having been received in cleared funds. Furthermore, for security and/or fraud-protection purposes, we reserve the right to request more documentation in order to process your booking, in case this is made twenty-four (24) hours prior to scheduled departure of initial itinerary for travel.
In relation to the "special requests" options relating to any product (eg meals, disabled facilities, child seats etc.), we do not guarantee any such requests.
If your travel plans change and you must cancel your booking please do so at the earliest possible time as many products have strict cancellation and refund policies and in some cases are non-refundable (refer to your booking Terms & Conditions for full details). If you do not cancel in advance you may also incur a “no- show” fee in addition to any other supplier fees charged.
If you wish to proceed with the cancellation, please either access your booking using the My Booking facility on our website, advising us of your specific requirements or you may call our Customer Support team on + 971 566282808 which is open 24 hours every day.
Darina Holidays reserves the right to replace Hotels of equal or superior star rating when necessary.
Darina holidays will not take over or take responsibility for any reservation at the hotel which was not booked through Darina Office
Most changes are minor. Occasionally we might need to make a major change, which would include a change of hotel due to hotel closure or overbooking; a pricing error. This list is not exhaustive and there may be other examples of a major change. Change of accommodation to another of the same or higher standard does not constitute being a major change.
In the unlikely event that the provider has to make a major change or alteration to your booking, we will offer you :
a) the option of accepting the change;
b) purchasing alternative Arrangements of a similar standard to those originally booked if available (if the alternative is less expensive than the original Arrangements the difference will be refunded to you, but if more expensive you will be asked to pay the difference); or
c) if we are unable to offer you a suitable alternative cancelling the booking and receiving a full refund of all monies paid to us in connection with the impacted booking.
If you cancel your booking, you may be entitled to a partial refund. In addition to the cancellation terms and conditions of your Supplier(s), our standard fees will apply as may be outlined on your receipt or booking confirmation.
The refundable portion of your purchase price (if any) will be refunded to you once we have received the funds back from the Supplier(s). To the extent we are refunded by the Supplier, we shall pass this refund onto you.
If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer.
If you have a booking for any of our products or services, including flights, but you do not show up to check-in or otherwise do not avail yourself of such product or service (“no show”), you will not be entitled to any refund. Subject to the relevant airline's policy you may, however, be entitled to a refund of any departure tax you may have paid for your flight (excluding low cost flights).
Payment can be made by the payment methods listed on the individual signed mutual agreement. Payment methods other than those stated are not accepted and no responsibility is accepted for cash or cheques sent through the post.
You authorize us or an authorized third party to take full payment for the total amount of your purchase. When pay by credit card, payment for your flights may be taken directly by the airline. Please note that you may be required to present your payment card at the time of check-in to provide confirmation of authorized card use or to secure any additional charges.
If there are any problems with your payment, we will contact you within 48 hours (or within 24 hours if you are travelling within 48 hours).
We will issue the confirmation for any booking within the amount of credit facilities.
We are not obliged to issue any tickets, confirmations, vouchers or other travel documents, in case the amount of the credit facility will be exceeded. In order to proceed with the confirmation, the payment process has to be finalized and the funds should be received in our bank account. However, in all cases the Customer remains liable for payment of the full amounts for the Services ordered.
After completion of the payment and booking confirmation, you will receive by Darina Holidays LLC all necessary documents (receipt, invoice) by e-mail to the e-mail address you have indicated during your booking.
Please ensure you have a passport valid for the duration of your trip. (Some destinations require your passport be valid for a certain length of time; in general, 6 months after completion of travel). You may also be required to obtain a visa for some destinations (including for transit points) and it is your responsibility to do so prior to travel.
When making a booking you must ensure that your name (and the name of any person(s) for whom you are making a booking) matches exactly the name as it appears in your (or the person(s) for whom you are making the booking’s) passport.
We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements and we take no responsibility for assisting or advising with this.
Each destination has its own requirements as far as entry formalities, vaccinations, etc. which can also vary depending on the passenger's nationality. It is your responsibility to collect that information. No incidents arising from the failure to comply with such official regulations will be considered our responsibility. We therefore urge you to always verify the different formalities of the chosen destination or transit countries, as well as the time needed to take all of the related steps.
You agree to indemnify us, including our officers, directors, employees and agents from and against any and all liabilities, expenses, legal and attorney’s fees and damages arising out of claims resulting from your misuse of this website and/or any material you post to or transmit through the Website or its servers, or any breach of this Agreement. Any of the damages must be proven by the party that claims it.
All content included on our site, such as text, graphics, logos, button icons, images, audio clips, and software ("Content"), is our property and is protected by international copyright and other intellectual property laws.
You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, reverse-engineer, license, create derivative works from, transfer, or sell any information, software, products or services obtained from this Web Site. Darina Holidays LLC, and any other product or trade names of Darina Holidays LLC referred to on the Web Site are our trade-marks or registered trade-marks. Other product and company names mentioned on the Web Site may be the trademarks of their respective owners.
We may change these terms and conditions at any time with advance notice. Changed terms will become effective once posted on the Web Site, and will not have any retrospective effect on existing contractual arrangements made through this Web Site. Your continued use of this Web Site after any change means you have accepted the changed terms and conditions
These terms and conditions and any other legal notices, policies and guidelines of Darina Holidays LLC linked to these terms and conditions constitute the entire agreement between you and Darina Holidays LLC relating to your use of this Web Site and supersede any prior understandings or agreements (whether oral or written), claims, representations, and understandings of the parties regarding such subject matter and the terms and conditions may not be amended or modified except by making such amendments or modifications available on this Web Site.
For the avoidance of doubt, references herein to "us" "we" and "our" shall also refer to our affiliates. The information, software, products, and services provided by us or our suppliers or published on our website may include inaccuracies or errors, including pricing errors. We expressly reserve the right to correct any pricing errors on our website and/or on pending reservations made under an incorrect price. In such event, if available, we will notify you about the inaccuracy/error within 24 hours and offer you the opportunity to keep your pending reservation at the correct price or we will cancel your reservation without penalty. Afterwards each side will take the responsibility for the inaccuracies/errors in order to protect the final customer.
Any ratings for suppliers are intended only as general guidelines, and we do not guarantee the accuracy of the ratings. We make no guarantees about the availability of specific products and services. We make no representations about the suitability of the information, software, products, and services provided by us or contained on our website for any purpose. The inclusion or offering of any products or services by us does not constitute our endorsement or recommendation of such product or service.
The carriers, hotels and other suppliers providing travel or other services on this website are independent contractors and not agents or employees of the us. We are not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.
We have no liability and will make no refund in the event of any delay, cancellation, strike, force majeure or other causes beyond our control, and we have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.
